TERMS AND CONDITIONS OF SALE
These Conditions of Sale apply, without restriction or reservation, to all sales of Products offered by JB Rose CosmEthic solely on the Internet site www.jbrosecosm-ethic.it.
They may be printed and stored by the Customer.
Consequently, ordering a Product for sale on the Internet site www.jbrosecosm-ethic.it implies full acceptance of the present Terms of Sale by the Customer, who signs that they have read them before placing the order.
In accordance with Article L.111-1 of the Consumer Code, JB Rose CosmEthic communicates the following information to the Customer:
The Customer takes note of the essential characteristics of the Products they intends to order.
The Products offered for sale on the Internet site www.jbrosecosm-ethic.it constitute the offer of JB Rose Cosm-Ethic. JB Rose CosmEthic reserves the right to change its product collection and ranges at any time.
The photos of the Products presented on our site are not contractual. Nevertheless, JB Rose CosmEthic makes every effort to ensure that the photos of the products on our site faithfully reproduce the products offered and do not give rise to any ambiguity as to size, weight or quality.
Sales of products on the www.jbrosecosm-ethic.it website are carried out by the company JB ROSE COSMETHIC SRL (share capital € 30,000.00) whose registered office is located in Ronco scrivia, Genova 16019, Fraz. JB Rose CosmEthic proposes the sale of its Products on the Internet site www.jbrosecosm-ethic.it to all consumers with the necessary legal capacity to complete a purchase transaction (hereinafter ‘Customer’). JB Rose CosmEthic cannot verify the actual legal capacity of each client.
The selling price of the Products indicated in Euro is that in force at the time of purchase. These prices do not include shipping costs, which are invoiced in addition to the price of the Products and indicated to the customer prior to order confirmation. Prices include the VAT tax applicable on the day of purchase. The offers presented by JB Rose CosmEthic are valid as long as they are on the Site and within the limit of available stocks. Information on the availability of the Products is provided when the order is validated.
JB ROSE COSMETHIC offers you the possibility of ordering by the method you prefer, in order to satisfy you as best as possible.
ON THE WEBSITE
Payment is made only by Credit Card or PayPal Circuit or by bank transfer.
The customer has the opportunity to check the details of their order and correct any errors. In the course of a purchase transaction, the customer may order a maximum of 10 items for the same product.
From the moment that the Customer confirms his order by clicking on the icon [“CONFIRM – Order with obligation to pay “], they subscribe that they are aware of the content and conditions of purchase, and in particular that they are aware of the Terms of Sale, prices, volumes, characteristics, quantities, and shipping conditions of the Products.
The sale will be final upon confirmation of the order by the customer, taking into account, however, the possibility for the customer to exercise his or her right of return (in accordance with the procedures set out below.) The order will then be confirmed by JB Rose CosmEthic who will send an e-mail to the customer, reiterating all the information specified above.
A second e-mail will then be sent to the customer when the order is dispatched.
JB Rose CosmEthic recommends the customer to keep both emails. The Customer is informed that the two e-mails will be sent to the e-mail address confirmed by the Customer when logging in, prior to placing the order. In the event of an error in the e-mail address or non-receipt of e-mails, JB Rose CosmEthic accepts no liability.
JB Rose CosmEthic assumes the right to collect the entire amount corresponding to the order: as regards payment by the methods accepted on the Internet Site from the time the email informing the customer of the dispatch of his order is sent
PRODUCT GIFT WRAPPING
If the customer so desires, JB Rose CosmEthic gives you free gift wrapping. JB Rose CosmEthic provides free packaging or gift bags so that customers can make their own packages. JB Rose CosmEthic reserves the right to choose which gift-wrapping to provide.
Place of dispatch
JB Rose CosmEthic delivers packages containing Products throughout the European Union.
The Products will be sent to the shipping address indicated by the Customer in the order.
This includes all taxes (VAT).
Product shipment times
The maximum shipping time is 7 days, calculated from the day the order is confirmed. For your information, starting from the receipt of the email confirming the shipment, the average delivery time is estimated as follows 4/6 working days for mainland Italy, 6/7 days for the islands.
These delivery times are for an order placed before 12 noon, for an item in stock and with payment by credit card or Pay Pal.
Methods of Product Shipment
Shipments will be made by courier against signature. The shipping price, including VAT, is €3.50 per order; this rate is valid exclusively for the Italian territory. For orders over € 100.00, shipping costs will not be charged.
Delivery of the Products to the Buyer will take place 4/6 (four to six) days after delivery of the goods to the courier, with the exception of the islands, for which 6-7 (six to seven) days are expected.
The Buyer will be able to monitor the progress of the shipment thanks to the tracking number he will receive by e-mail or via Customer Service.
In the event of the absence of the Purchaser or a person authorised by the courier to take delivery of the Products, a second delivery attempt shall be made the following day. A possible third attempt will have to be agreed upon.
In the event of non-delivery, the goods shall be held by the post office in the Buyer’s city for 10 (ten) days and then returned to the Carrier’s Italian headquarters. If the collection deadline is not met, the goods will be returned to the JB Rose CosmEthic warehouses and the delivery costs will still be invoiced to the Buyer. Ordered products may be refunded or returned.
RIGHT OF OWNERSHIP
JB Rose CosmEthic reserves the right of ownership of the Products ordered until full payment of the purchase price by the purchaser.
JB Rose CosmEthic is committed to the proper performance of its obligations under the contract. Occasionally, JB Rose CosmEthic may withdraw from its liability in whole or in part by proving that the non-performance or poor performance of the contract is attributable to either the customer or a third party involved in the contract, or in cases of force majeure (e.g. strikes, accidents, riots, fires, etc., constituting unforeseeable and uncontrollable events). JB Rose CosmEthic cannot be held liable for any inconvenience or damage resulting from the use of the Internet.
As soon as the Customer or a third party designated by him and different from the courier in charge of the service takes physical possession of the ordered goods, all risks of loss of or damage to the said goods lapse.

AVAILABILITY OF PRODUCTS AND GIFT CARDS
Please be informed that we do our utmost to ensure the availability of the Products. Offers for Products are valid as long as they remain visible on the site and while stocks last.
Information concerning the availability or non-availability of the Products is provided to the Customer at the time of ordering. If a Product ordered is not actually available when the package is prepared, JB Rose CosmEthic will automatically send an information e-mail to the Customer.
The Customer may then:
– Replace the Product with another Product of equivalent cost (except in case of Product on offer)
– Receive the remainder of the order without the finished Product, deducting the cost of the missing good from the order total, which will then not be charged to the Customer
– Cancel the entire order.
LEGAL PRODUCT WARRANTY
In the event of a conformity defect or in the event of hidden defects in the product and in compliance with the conditions laid down by law, you must address your complaints to JB Rose CosmEthic by post by writing to :

In the event of a conformity defect, JB Rose CosmEthic will replace the Product with the same or an equivalent one. The replacement will be carried out within a maximum period of 1 month after receipt of the Product.
JB Rose CosmEthic reminds its customers that JB Rose CosmEthic Cosmetic Products must be stored away from moisture or intense light sources and not exposed to temperatures above 30 degrees Centigrade; they are also subject to an expiry date. Cosmetic Products that have not been stored according to the specified instructions will therefore be excluded from the guarantee.
RETURN AND EXCHANGE OF PRODUCTS LEGAL WARRANTY
Please note that you may benefit from the legal warranty of conformity and the legal warranty for product defects. In the event of any product defect, JB Rose CosmEthic undertakes to replace the Product in question with an identical or equivalent one. The exchange will be made within a maximum period of 15 days from the day the package is received.
JB Rose CosmEthic reminds its customers that its Cosmetic Products must be stored in dry places, not exposed to temperatures above 30 C or sources of intense light. They are also subject to an expiry date. Cosmetic products that are not stored in the manner indicated will therefore be excluded from the guarantee.
RIGHT OF RETURN
You have the right to withdraw from this contract without giving a specific reason within a maximum period of 14 days.
The right of return expires 14 days after you or a third party designated by you physically take possession of the goods.
To exercise this right, you must notify us of your decision to withdraw from this contract by means of a clear and precise statement (e.g. by a letter sent by post to JB ROSE COSMETHIC CUSTOMER SERVICE – Fraz. Pietrafraccia 163-Ronco Scrivia – 16019 –GE (ITALIA) or by email email@example.com
For the right of return to be respected, it is sufficient to transmit your request to exercise this right before its expiry.
In the event that you wish to withdraw from this contract, we will reimburse you for the amount paid by you, excluding delivery charges, no later than 30 days after we are informed of your decision to withdraw from the contract. We will process the refund using the same payment method you used for the initial transaction; however, the refund will not result in any additional costs for you. at the latest 14 days after communicating the decision to withdraw.
We also inform you that you will have to bear the return shipping costs of the product.
You have no liability for depreciation of the asset if you merely handle it in a manner appropriate to establishing its nature, characteristics and proper functioning. All products must be returned to us in their original packaging, as they were when they arrived. JB Rose CosmEthic will have a period of 4 days from receipt of your parcel to check the status of the products.
For Cosmetic Products: For health and hygiene reasons, we also inform you that you will lose any right to return cosmetic products if they have been opened after delivery.
For opened Cosmetic Products, we therefore confirm that the right of return cannot be applied for the above-mentioned hygienic and health reasons. JB Rose CosmEthic will therefore not refund their payment under any circumstances (shipping costs excluded);
– shall demand reimbursement of all payments (excluding shipping costs) if it has already reimbursed the Customer.
For all Products marketed under the JB Rose CosmEthic brand name (excluding Cosmetic Products) that have been deteriorated, JB Rose CosmEthic will apply a 50% reduction on their original price (excluding shipping costs) as these products will no longer be marketable due to the damage suffered and:
– will refund their payment (excluding shipping costs) at a 50% reduction on the original price;
– will demand a refund of all additional payments (including shipping costs) if the goods have suffered a 50% depreciation and JB Rose CosmEthic has already refunded the Customer in full.
In case of any problem or doubt, JB Rose CosmEthic invites you to contact Customer Service directly and solely.
Disagreements or disputes arising out of or in connection with a contract concluded between JB Rose CosmEthic and the Customer may be resolved through mediation/conciliation. Sales of Products on this site are subject to Italian law, whatever the Customer’s country of residence or the place where the order is placed. Any dispute concerning the existence, interpretation, execution or waiver of a contract concluded between the Customer and JB Rose CosmEthic is subject to the exclusive jurisdiction of the court of Genoa-Italy.
PRIVACY, DATA PROTECTION & RIGHT TO COMPLAIN BY TELEPHONE
Our Internet server automatically recognises the domain name (of the Internet connection provider) and when possible the e-mail address of users visiting our site. We inform you that we centralise domain names for statistical purposes, and use the information communicated in order to improve the content of the pages of our site.

JB ROSE COSMETHIC reserves the right to change the content or characteristics of the General Terms and Conditions of Sale at any time. Each order shall give rise to acceptance of the General Terms and Conditions of Sale in the version in force at that time. If the General Terms and Conditions of Sale are changed, they shall not apply to orders concluded before the changes.
The companies of the JB ROSE COSM-ETHIC group are the owners of all intellectual and industrial property rights relating to the Internet Site and the JB ROSE COSM-ETHIC brands, for which they also hold the rights of use.
Access to the aforementioned Internet Site does not grant you any right to intellectual property rights relating to the site, which remains the exclusive property of the companies of the JB Rose Cosm-Ethic Group.
The general structure of the site, as well as the elements accessible on the site, in the form of texts, photographs, animated and non-animated images, icons, maps, videos, software, databases and all other elements forming part of the site, are the exclusive property of the JB Rose Cosm-Ethic Group.
